You need a building permit to build, replace, or extend a fence or privacy wall, whatever its height. Miami writes its own list of work that skips a permit in Sec. 10-5, and the Building part of that list covers only wallpaper and interior finish work, painting, floor finishes, cabinets and countertops, shade cloth structures for nurseries, playground swings, small movable indoor fixtures, and ordinary minor repairs. Fences are not on it. The state list in FBC 105.2 has no Building category at all, so it does not exempt a fence either. Fence height limits in the zoning code are a separate rule and do not take the place of the permit.
